Big Rivers’ Open Tariff Filings

1. On June 29, 2026, Big Rivers filed, via the Public Service Commission’s Electronic Tariff Filing System proposed tariff sheets for a new Interim Energy Adjustment (IEA) tariff, along with related changes to the Rural Delivery Service (RDS), Large Industrial Customer (LIC), and Fuel Adjustment Clause (FAC) tariffs, and the tariff table of contents. The tariff filing was made pursuant to Commission’s final orders in PSC Case No. 2024-00141 and 2024-00149, where the Commission found that Big Rivers should include sales to Nucor Corporation in the calculation of the FAC, which would have the effect of Big Rivers not recovering the fuel and purchased power costs it incurs for service to Nucor Corporation through the FAC. The Commission further found that “because reasonable costs to serve Nucor are eligible for possible recovery by BREC...BREC may recover these reasonable costs through the proposed ‘Interim Energy Adjustment’ tariff, which will appear as a separate line item on monthly bills.” Big Rivers filed the new IEA tariff pursuant to the Commission’s direction in those cases. 

The new IEA tariff will apply to both Big Rivers’ Rural class (through the RDS tariff) and Large Industrial class (through the LIC tariff). The proposed changes to the RDS and LIC tariff are simply to add a reference to the IEA tariff in those tariffs, including to the sample invoices in those tariffs. The proposed changes to the FAC are intended to clarify that sales to Nucor are included in the calculation of the FAC, while market-based sales to Members to which the FAC is not applied by special contract are not included in the calculation. This includes market-based sales to Block Mining, Inc., who is directly allocated and who is responsible for the costs of power purchased in the MISO markets for the power it uses.

The issue date of the new and revised tariffs is the date the tariff changes were filed, June 29, 2026, and the tariff changes have a proposed effective date of September 1, 2026. 2. On November 3, 2025, Big Rivers filed, via the Public Service Commission’s Electronic Tariff Filing System proposed tariff sheets to revise its Pole Attachment Tariff (TFS 2025-00493). The tariff filing was made pursuant to the Commission’s revised Pole Attachment Regulation, 807 KAR 5:015, which became effective on September 18, 2025.  The new regulation substantially tracks the February 25, 2025, emergency amendments to the Pole Attachment Regulation, 807 KAR 5:015E.  Consequently, the only changes made to Big Rivers’ existing PA Tariff are the issue date, effective date, and the statement related to the authority by which the tariff is issued, located at the bottom of each page. 

The Commission is reviewing the proposed tariff in Case No. 2025-00392, In the Matter of: Electronic Investigation of the Proposed Pole Attachment Tariffs of Rural Electric Cooperative Corporations.  The Commission suspended the proposed tariff for five months from December 3, 2025, up to and including May 3, 2026, by order dated, December 2, 2025.  On April 17, 2026, Kentucky’s electric cooperatives requested that the case be submitted for decision on the existing record and the matter remains pending final order.

Pole Attachments - 807 KAR 5:015

For a single attachment or a larger project, all pole attachment requests must follow Big Rivers' Pole Attachment Tariff, as approved by the Public Service Commission of Kentucky. 

Potential and current pole attachment customers may contact our Transmission Engineering Department directly at the following address: BREC.PoleConnect@BigRivers.com. This group is responsible for attachment and joint use agreements, managing the attachment and approval process, design and construction standards, and billing.
